1. Agreement to Terms

By accessing or using Endersite ("the Platform"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Platform.

2. Eligibility

To use Endersite, you must:

• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the service under applicable laws
• Provide accurate and complete registration information

By creating an account, you represent and warrant that you meet all eligibility requirements.

3. Account Responsibilities

When you create an account, you agree to:

• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account
• Keep your account information accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these terms or engage in suspicious activity.

Endersite is an AI-integrated website content management system that enables users to create, manage, and deploy websites. Our platform includes:

• AI Page Builder: Generate website sections using natural language
• Content Management: Create and organize pages, blogs, and media
• Multi-site Management: Manage multiple websites from one dashboard
• AI Chat Features: Conversational interfaces for site visitors
• Hosting & Deployment: Fast, reliable website hosting

Features may vary by subscription tier. We reserve the right to modify, suspend, or discontinue features with reasonable notice.

5. Acceptable Use Policy

You May:

• Create and publish websites for lawful purposes
• Use AI features to generate and enhance content
• Customize your sites within platform capabilities
• Export your content at any time

You May Not:

Violation of these policies may result in immediate account termination without refund.

6. AI Usage Terms

Our AI features are powerful tools with specific terms of use:

• Content Review: You are responsible for reviewing all AI-generated content before publication
• Accuracy: AI may generate inaccurate information; verify facts independently
• Prohibited Uses: Do not use AI to generate illegal, deceptive, or harmful content
• Rate Limits: AI features are subject to usage limits based on your subscription tier
• No Guarantees: AI outputs are provided "as-is" without warranty of accuracy or fitness

7. Intellectual Property

Your Content

You retain ownership of all content you create using Endersite. By using the platform, you grant us a limited license to host, display, and transmit your content as necessary to provide the service.

AI-Generated Content

Content generated by AI features is owned by you, subject to:

• Our right to use anonymized patterns for service improvement
• Underlying AI model terms from our technology providers
• Your responsibility to ensure content doesn't infringe third-party rights

Platform IP

Endersite's platform, including its software, design, branding, and documentation, remains our exclusive property. You may not copy, modify, or distribute any part of the platform without written permission.

8. Payment & Billing

• Subscription Fees: Paid monthly or annually based on your chosen plan
• Automatic Renewal: Subscriptions renew automatically unless cancelled
• Price Changes: We'll notify you at least 30 days before any price increases
• Refunds: Refunds are handled on a case-by-case basis; contact support
• Failed Payments: We may suspend access after failed payment attempts

All fees are exclusive of taxes, which you are responsible for paying.

9. Disclaimers & Limitations

Service Provided "As Is"

Endersite is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Endersite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Endersite, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the platform
• Content you create or publish
• Your violation of these terms
• Your violation of any third-party rights

11. Termination

By You

You may cancel your account at any time through your account settings or by contacting support. Upon cancellation, you'll retain access until the end of your billing period.

By Us

We may suspend or terminate your account immediately if you:

• Violate these terms or our acceptable use policy
• Engage in fraudulent or illegal activity
• Fail to pay fees after notice
• Create risk or legal exposure for us

Effect of Termination

Upon termination, your right to use the platform ceases immediately. We may delete your data after a 30-day grace period unless legally required to retain it.

12. Modifications to Terms

We may update these terms from time to time. Material changes will be communicated via email or platform notification at least 30 days in advance. Continued use of Endersite after changes take effect constitutes acceptance of the new terms.

13. Governing Law & Disputes

These terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles.

Any disputes shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

14. General Provisions

• Entire Agreement: These terms constitute the entire agreement between you and Endersite
• Severability: If any provision is found unenforceable, the remainder stays in effect
• Waiver: Failure to enforce a right doesn't waive that right
• Assignment: You may not assign your rights without our consent; we may assign ours
• Force Majeure: We're not liable for delays due to circumstances beyond our control
